GTC of training

The following General Terms and Conditions apply to the booking and participation of all educational and course offers of MEB Safety Services GmbH.

Registration, contract conclusion and contract periodt

Booking a course or registering one or more course participants is only possible through the online booking portal. Places in the course will be allocated according to the date of receipt of the application.

By registering, the participant bindingly accepts the course offering. If a place in a course is free, the contract is concluded at the time of registration. After successful course registration, the participant will receive a confirmation email to the email address provided by the participant. The confirmation declaration contains the essential contents of the course registration. The participant must check these immediately for their correctness. Incorrect information must be reported to the provider immediately. General entitlement to participation does not exist.

The participant or applicant is obliged to provide truthful information when registering on the provider’s booking tool. If the duty of truth should not be breached, the user account can be blocked. The participant must ensure that the email account specified by said participant is accessible.

Should the participant’s data changes, in particular address or email address, said participant is obliged to inform the provider if the course is affected by the change. In particular, this includes contact addresses which are relevant for sending course confirmation and preparing the participant documents.

The contractual relationship ends with the last day of the selected training measure or participation in the examination. Any outstanding payment obligations on the part of the participant resulting from the educational offerings, as well as the description in these General Terms and Conditions, shall remain in effect after the end of the contract until they have been completely fulfilled.

MEB Safety Services GmbH undertakes to issue a certificate of participation to the participant on request even if the examination is not passed. The prerequisite for this is in any case the fulfilment of the contractual obligations on the part of the participant or the grantor. This confirmation can also be provided by third parties (e.g. the certifying association).

Cancellation

Participants have the right to revoke their contractual declaration within 14 days. Course fees that have already been paid will be fully refunded by MEB Safety Services GmbH in this case.

If the cancellation is made 14 to 7 days before the start of the course, we charge 50% of the total course fee as cancellation costs. In case of cancellation 7 to 3 days before the start of the course we charge 85% of the total course fee as a cancellation fee and in case of cancellation less than 3 days before the start of the course, we charge the full course fee.

This regulation applies without exception to all our course offerings. Payment of the course fee is always valid for the period of the booked course. The course fee already paid cannot be offset against a course at a later date if the participant cancels.

Acceptance of a replacement participant named in place of the original participant who registered is subject to the prior consent of MEB Safety Services GmbH. The same conditions apply to the replacement participant as to the original applicant.

Participants who have applied for a subsidy according to SGB III have a general right of withdrawal free of charge if the costs are not covered by the sponsor of the corresponding training measure or if the start of work takes place before the start of the training measure which is not related to the training offer of MEB Safety Services GmbH.

The cancellation period begins with the sending of the booking confirmation (conclusion of contract) on the part of MEB Safety Services GmbH and the fulfilment of our information duties according to article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB. To meet the deadline, it is sufficient to send the cancellation in due time (postmark, date of fax or email). The period for cancelling the contract declaration also includes Saturdays, Sundays and public holidays. A verbal cancellation, e.g. by a telephone call, is not permitted.

Costs

The costs depend on the type of educational offering selected and can be inquired by telephone or taken from the respective course descriptions on the Internet.

Included in the costs: course fees, training documents, examination fees and, if the examination is passed, appropriate proof in the form of a certificate and identity card. Costs, e.g. for replacement certificates and identity cards, resulting from incorrect information (including typing errors) during registration are to be borne by the applicant.

Complete rental equipment can be rented for the duration of the course from MEB Safety Services GmbH for a fee. This must be noted in advance in the registration. The cost of rental equipment depends on the type of course (see course descriptions for details) and is charged in addition to the fees of the chosen course.

Terms of payment

Payment of the course fee is made upon receipt of invoice, by MEB Safety Services GmbH, before the start of the training.
The course fee must be credited to our account at least 14 days before the course begins. For registrations at short notice (less than 14 days prior to the start of the course) a correspondingly different payment date can be agreed with MEB Safety Services GmbH, however, payment before the start of the course is mandatory. MEB Safety Services GmbH reserves the right to exclude participants who have not or not completely transferred the course fee before the start of the course from participation in the course. Partial payments already made will not be refunded. Payment by instalments is generally not possible.

Participants who are supported as vocational training and further training measures must submit all necessary documents (e.g. training voucher) to the relevant funding agency (e.g. job centre/agency for employment) at least 7 days before the start of the training. The training voucher must be presented to MEB Safety Services GmbH for completion at least 14 days before the start of the course. The participation fees are settled directly with the responsible office (funding agency) on the basis of the education voucher submitted.

Requirements for participation

The participant must meet or fulfil all participation requirements for the relevant training programme. The prerequisites depend on the type of training course chosen and can be inquired by telephone at our office in Bremen or taken from the respective course descriptions on the Internet.

If, at the latest at the beginning of the course, the appropriate proof is not made available, participation is not possible. In such cases, MEB Safety Services GmbH is entitled to terminate the contract. In principle, there is no claim to reimbursement or offsetting of the course costs. Course fees must be paid in full.

Content and duration

Training content corresponds to the description and the offer valid at the beginning of the course. The essential content as well as the duration depend on the type of course chosen and can be inquired by telephone or taken from the respective course descriptions on the Internet.

Rights and responsibilities

The primary and decisive goal of MEB Safety Services GmbH is the achievement of the training goal for the participant, taking into account safety-relevant aspects and the respective legal provisions and regulations. Participants undertake to treat the classrooms, inventory, learning aids, rental materials, etc. made available to them with care and to follow the instructions of the trainers and instructors of MEB Safety Services GmbH. The operating instructions and house rules of MEB Safety Services GmbH are a binding guideline.

Due to the brevity of the individual measures, the participant undertakes to attend classes regularly. Should the course objective be in danger due to absenteeism, the responsible trainer of MEB Safety Services GmbH will conduct a consultation with the participant and, if necessary, the responsible sponsor or employer. The purpose of this meeting is to discuss the options that could lead to a successful completion of the action by the participant. Unexcused absences can, depending on their extent, lead to an immediate exclusion of the participant from the training measure. This decision is made by the responsible trainer/instructor in consultation with the training manager of MEB Safety Services GmbH. In the case of participants for whom the training measure is supported by a funding body, the competent body will be informed of the cirumstances. In case of exclusion of participants due to absenteeism (excused or unexcused) or in case of violation of the house rules or instructions of the instructors, course fees will not be refunded, and the participants will not be entitled to receive a certificate of attendance or participation in a course at a later date.

The respective course is completed with an examination or certification. The provider does not guarantee successful completion. If the course participant does not pass the offered exam, no certification will be granted. A follow-up examination which must be paid for, can be taken. Failure to pass the examination does not entitle the participant to a refund of course and examination fees.

The course contents, the course titles and the course documents, in particular scripts and presentations may only be reproduced or used for the holding of events with written permission. Photographs or film recordings and their publication in print media, on the Internet (including social networks such as Facebook, etc.) generally require the permission of MEB Safety Services GmbH and the persons depicted/recorded. This applies equally to photographs or films showing any kind of superstructures or installations in our training facilities. Should recordings be made contrary to this agreement, the image or sound material shall become our property against reimbursement of the material costs. All rights to image and sound material are owned by MEB Safety Services GmbH. MEB Safety Services GmbH reserves the right to take legal action.

Cancellation of training measures

MEB Safety Services GmbH may cancel training measures for good cause. Important reasons include above all too few participants, lack of trainer availability or force majeure. No liability can be accepted for any damages resulting from the cancellation of educational measures.

MEB Safety Services GmbH will name alternative dates in case of cancellation. Course fees already paid will not be refunded but can be offset against a course on an alternatively named date.

Termination

MEB Safety Services GmbH reserves the right to terminate the contract in case of repeated or grossly negligent behaviour of the participant against instructions or orders of the trainers or instructors. In the event of cancellation for good cause, the course fees will not be refunded. Should MEB Safety Services GmbH suffer disadvantages due to a cancellation, which impair the smooth running of the course, we will assert any legal claims, also from other participants of the course, against the cancelled participant. In the case of participants for whom the training measure is supported by a funding body, the competent body will be informed of the misconduct.

Liability/collateral agreements

We are not liable for any damages or legal consequences that may occur due to participation or non-participation in our training measures. This exclusion of liability also applies in favour of the legal representatives and vicarious agents of MEB Safety Services GmbH if the participant asserts claims against them. MEB Safety Services GmbH is not liable for loss, damage or theft of objects of any kind.

Collateral agreements must be made in writing to be effective.

Privacy

Personal data required to carry out the measure and to issue the identity cards and certificates are stored and processed within the scope of the contractual relationship. This data will not be passed on to third parties, except in the case of service partners (e.g. Fachverband für Seilunterstütze Arbeitstechniken, FISAT e. V.) who require the participant’s personal data in order to process the contract in connection with participation in examinations.

MEB Safety Services GmbH reserves the right to send information to the participants at regular intervals by means of an “email newsletter” after completion of the measure. This information includes, for example, safety-relevant information from manufacturers, trade associations or the employers’ liability insurance association, job offers, course dates and reminders of upcoming repeat training. The participant may cancel subscription to this “email newsletter” at any time without providing reasons.
